Show your witness the hard documents before opposing counsel does.
Prep time should go to the case, not to the witness struggling with screen-sharing software.
Set it up the same way you’ll run the deposition
- 01
Build a prep folder
Put in only the documents you want the witness to see. They can’t browse the rest of the case.
- 02
Walk through the documents
Invite the witness and show the documents one at a time. Let them page through, annotate and get used to the witness view.
- 03
Rehearse if you want to
For a full run-through, hold the session as a mock deposition with exhibit stamps and a questioning attorney. Mock depositions don’t use a credit.
- 04
Go again if you need to
The folder stays in the case, so a second session picks up where the first one ended.
What prep catches early
Remote witnesses
Test the connection, the browser and the iPad during prep, not at 9 a.m. on the day of the deposition.
A document the witness has never seen
Walk through it with them in prep so the first time isn’t on the record.
