Remote Deposition Best Practices

A preparation checklist for attorneys running remote proceedings with AgileLaw. A little preparation before the deposition starts prevents almost every issue that comes up during one.

Before the deposition

Upload and organize all exhibits

Upload every exhibit you might use before the deposition starts. Organize them in the order you plan to use them — last-minute uploads create unnecessary pressure during a live proceeding.

Pre-search anticipated topics

Run keyword searches on topics you expect to cover the night before. Having documents already surfaced means you're never scrambling mid-deposition when the direction shifts.

Send invitations at least 24 hours early

Send each participant's invitation or PIN well before deposition day. Ask them to click the link and confirm they can access it — don't wait to find out on the day of.

Confirm access with your court reporter

Reach out to your court reporter directly to confirm they've received their invitation and successfully accessed AgileLaw. Court reporter access issues are the most common source of delays.

Equipment and connectivity

Use a wired internet connection

Connect your computer to your router with an ethernet cable if possible. Wired connections are significantly more stable than WiFi for live proceedings where dropped packets cause real problems.

Test your camera and microphone

Run an AV test at least 30 minutes before start time. Check that your video is clear and your audio doesn't echo. Headphones with a built-in microphone reduce echo considerably.

Close unnecessary apps and browser tabs

Shut down applications you won't need during the deposition. Fewer open programs means more system resources available for screen sharing, video, and the AgileLaw interface.

Day of

Admit all participants before going on the record

Start the session early and admit everyone — witness, court reporter, co-counsel, and opposing counsel — before the official record begins. Resolve any access issues off the record.

Assign participant roles before starting

Verify that each participant has the correct role set in AgileLaw before you start. Roles control what each participant can see and do — a misassigned role is disruptive to fix mid-deposition.

If a participant has trouble connecting, visit support.agilelaw.com or contact the AgileLaw team directly. Having the support page bookmarked means you're not searching for it under pressure.
